1. Our Service

 

DNA Doctors is a Nutrition and Wellness institution that provides;

​

1- Nutrition and lifestyle coaching based on precision medicine concepts, including weight management, body composition, skin health, longevity and healthy aging by licensed health care professionals 

2- Education for health care professionals on personalized nutrition and lifestyle concepts

3- Executive health and Work place health and wellness seminars and services

4- Genetic test kits, genotyping, unique customized reports and related services for personalized nutrition, fitness, lifestyle and metabolic pathways for pharmaceuticals to clinicians, health and wellness clinics through licensed healthcare professionals

(collectively referred to from here on the “DNA Doctors Service”).

DNA Doctors provides its test kits through healthcare professionals working internally, externally to private practices or as part of a health and wellness clinic (the “Healthcare professional” or “Clinic”).

You should only receive this service through a consultation with a healthcare professional, and by agreeing to provide the DNA Doctors service, your healthcare professional, or the Clinic on behalf of its healthcare professionals, has warranted to us that they are a healthcare professional, appropriately accredited and in good standing.

DNA Doctors makes no warrants about its product whatsoever and does not provide any support if you have used the DNA Doctors test kit in any way other than through a healthcare professional.

By using the DNA Doctors service, you also represent and warrant that any saliva samples you submit to us as part of the Service are your own, that you have followed the saliva collection instructions provided by your healthcare professional and that you will not use our website or the Service for any purpose that is unlawful, unethical or in violation of these Terms.

All sales are final. All DNA Doctors tests and services are non-refundable.

2. DNA Doctors is Not Medical Advice

The DNA Doctors Service, including test results, your personalized nutrition report (Report) and any other information provided in our materials or on this website, is for information purposes only, and is not a substitute for medical advice, diagnosis or treatment.

The DNA Doctors Service is provided through your healthcare professional. You may speak to them to discuss background information regarding your Report. However, healthcare professionals and clinics are expected to adhere to all applicable laws and professional rules and regulations concerning the provision of nutritional advice. The DNA Doctors test kit is not a diagnostic test.

Regardless of any information contained in, related to, or given in association with your Report, you should seek the advice of a physician or other qualified health provider if you have questions regarding any medical condition, or if you are experiencing any symptoms you believe to be a medical condition. You should not ignore professional medical advice or delay in seeking it because of any information contained in your Report. You should not interpret your Report or any other information provided in relation to it as recommending any specific treatment plan, product or course of action related to a treatment for a medical condition. Always consult your physician or other qualified health provider before starting any new treatment, or stopping any treatment that has been prescribed for you by your physician or other qualified health provider.


 

3. Privacy and Security of Information

DNA Doctors takes your privacy and the security of your information very seriously. Only your healthcare professional will be able to access your genetic test results. Your DNA Doctors test kit is marked with a unique barcode, which is what our laboratory will use to analyze your sample. Only your healthcare professional will be able to link your kit’s barcode to your personal information.

DNA Doctors uses the Hyper Text Transfer Protocol Secure (HTTPS) and Secure Socket Layer (SSL) certified site to ensure the data that travels between your server and the site is encrypted and authenticated information over the Internet. This technology ensures that confidential information cannot be viewed, intercepted or altered.

DNA Doctors will store your bar-coded and anonymized DNA sample so that you will have the opportunity to be tested for additional genetic variants as new discoveries are made and the science develops. We do this so that new tests can be performed at your request without the need to collect another saliva sample and its associated costs. However, you may have your sample destroyed by sending a written request to your healthcare professional, who will inform DNA Doctors.

Your personal genetic information will never be disclosed to a third party without your explicit written consent to do so, unless required by law.

DNA Doctors may update our privacy and security policies and practices from time to time. We will continue to use commercially reasonable safeguards against unauthorized disclosure of or access to your genetic data or other personally identifiable information about you.

However, by agreeing to use the DNA Doctors Service, you acknowledge that security safeguards, by their nature, are capable of being circumvented and that DNA Doctors cannot guarantee that personally identifiable information about you will not be accessed by unauthorized people who are able to overcome such safeguards, including actions aimed at accessing information over the Internet.

You should be careful about sharing the results of your Report and any related information. Genetic information that you share with others may be used against your interests. You may wish to seek legal advice to understand the extent of legal protection of your genetic information before you share it with anybody. Genetic information that you choose to share with your physician or other health care provider may become part of your medical record and may become accessible to other health care providers or insurance. If you are asked by an insurance company whether you have learned about your genetic information and you do not disclose this to them, this may be considered to be fraud.

DNA Doctors cannot be responsible for any personally identifiable genetic information about you that you release on your own, or that you request or authorize us to release.

4. Copyrights and Trademarks

The DNASculpt name and logo are trademarks of DNA Doctors Inc. DNA Doctors owns all of the content in its materials, including the content of this website. All content, trademarks, service marks, trade names, and products on this website and in our materials are protected in Canada, the United States and internationally. No use of any of these may be made without the prior, written authorization of DNA Doctors Inc.

DNA Doctors grants you a non-exclusive, non-transferable, revocable, limited license to receive our Services that you purchase from a healthcare professional, and to view and print one or more copies of your Report and a single copy of any other content obtained by you from our website, for your non-commercial personal use only, provided that you do not remove or obscure any copyright notice, trademark notice, or other proprietary rights notices.

5. Warrants, Liability and Indemnification

Our site, Services, your Report and other content are provided on an "as is" basis, and you use them at your own risk. DNA Doctors expressly disclaims all warranties of any kind, whether express or implied, including, without limitation, any warranties of merchantability, fitness for a particular purpose, or non-infringement. DNA Doctors makes no warranties as to the accuracy, quality or reliability of our site, the Services, your Report or other content, or any results that may be obtained from their use, or advice based on their use.

DNA Doctors assumes no responsibility for any consequence relating directly or indirectly to any action or inaction you take based on our site, Services, your Report or other content, or any advice you may receive based on these. You must evaluate and bear all risks associated with their use, including any reliance on their accuracy or completeness. In no event will DNA Doctors, its licensors, practitioners  or suppliers be liable for any special, indirect, incidental, punitive, or consequential damages however caused.

You agree to indemnify, defend and hold harmless DNA Doctors, its licensors, suppliers, and their respective directors, officers, employees, agents, affiliates, successors and assigns, from and against any and all claims, damages, losses, costs and other expenses that arise from your use of our site, Services, your Report or other content, from your breach of these Terms, or from any data or communications you submit, post or transmit to or through our site.
 

These Terms of Service May Change

DNA Doctors may make changes to its privacy policy and terms of service from time to time. When these changes are made, DNA Doctors will make a new copy of these available on its website.

You acknowledge and agree that if you use our Services after the date on which the privacy policy and terms of service have changed, DNA Doctors will treat your use as acceptance of the updated privacy policy and terms of service.

Nutrigenomics DNA Test 

Client Consent Form

Each client is required to read, acknowledge, and agree to the terms in this Consent Form before their sample can be processed. This ensures each client understands the process, knows what to expect, is aware of the benefits, limitations, and potential risks, and fully understands the service being provided before agreeing to proceed.

By agreeing to the conditions in this form, the client authorizes DNA Doctors to:

  1. Analyze their DNA for specific genetic markers that influence individual variation in drug response.

  2. Destroy their DNA sample once testing has been successfully completed (within a maximum of 90 days of receiving the test sample).

  3. Collect, use, and disclose their personal information (some of which may constitute personal health information), including name, address, phone number, email address, private insurance information (if applicable), various health information, and genetic information, for the purposes of providing and managing the services requested.

What is Nutrigenomics Testing?

Nutrigenomics (NGx) testing is an innovative, non-invasive approach that utilizes a simple saliva collection kit or buccal swab to analyze an individual’s DNA. Designed for use by healthcare professionals, this testing method delivers comprehensive and scientifically validated genomic insights. The primary objective is to identify genetic variations that influence an individual’s response to nutrition, lifestyle factors, and physical activity. NGx provides comprehensive and reliable genomic insights with the goal of optimizing an individual’s health, wellness, and performance through personalized recommendations.

This testing evaluates genetic variations that influence a range of physiological and metabolic processes, including but not limited to:

  • Nutrient metabolism and absorption

  • Dietary intolerances

  • Detoxification capacity

  • Energy metabolism and utilization

  • Sleep patterns and recovery

  • Physical performance and fitness capacity

  • Pain tolerance

  • Taste perception and dietary habits

The testing process includes DNA collection, analysis, and the generation of a personalized report offering evidence-based recommendations for nutrition, lifestyle, and fitness strategies tailored to the client’s unique genetic profile. The accuracy of these genetic analyses ranges from 99.7% to 100%.

What are the Benefits?

Nutrigenomics testing offers actionable insights that empower individuals to:

  • Optimize nutrition and dietary choices to improve metabolic health.

What are the Risks?

There are no physical risks associated with nutrigenomics testing. However, some individuals may have concerns regarding the privacy and security of their genetic information.

In the United States, the Genetic Information Non-Discrimination Act (GINA) (2008) and the Health Insurance Portability and Accountability Act (HIPAA) (1996) offer federal protection against genetic discrimination in employment and health insurance. However, life insurance policies are not protected under these acts.

In Canada, the Genetic Non-Discrimination Act (GNA) (2017) prohibits insurers and employers from using, requesting, or requiring genetic test results. The act also bans discrimination based on genetic characteristics under the Canadian Human Rights Act. However, the GNA does not protect family medical history or current diagnoses, even when genetically linked.

Note: Nutrigenomics testing does not identify or diagnose disease-causing mutations. However, if an individual has undergone genetic testing, they may be required to disclose this on legal or insurance forms that inquire about genetic tests.

What are the Limitations?

Nutrigenomics testing is not a diagnostic tool and is not intended to treat, prevent, mitigate, or cure any disease. Factors such as age, environment, diet, ethnicity, lifestyle, family medical history, and pre-existing health conditions may influence outcomes independent of genetic predispositions.

The recommendations provided are based on validated genetic research and offer probabilistic insights rather than definitive conclusions. While the results may enhance personalized care, they do not guarantee specific health outcomes. Clients are strongly advised to consult with a qualified healthcare professional before making any changes to medical care, including medication dosages or treatments.

How Will the Information Be Protected?

All personal health information, including nutrigenomics test results, is protected by the healthcare professional or clinic providing the test. Each sample is anonymized using a barcode and entered into a password-protected portal system and medical electronic charting. DNA Doctors uses a Secure Socket Layer (SSL) protocol to encrypt information transmitted over the Internet. This technology uses 256-bit encryption, ensuring that confidential information and transactions cannot be viewed, intercepted, or altered. DNA Doctors will never reveal client information or genetic data to a third party except as required to provide the requested services or as required by law.

What Happens to the DNA Sample After Testing?

After testing is completed, the anonymized DNA sample will be securely stored to enable future testing as advancements in genetic research become available. Clients may request the destruction of their DNA sample at any time by contacting info@dna-drs.com. DNA Doctors does not share or sell genetic data to third parties and will not conduct research using DNA samples without explicit client consent.

Refund Policy

All sales are final. Nutrigenomics tests and related services are non-refundable.

Will the Level of Care Be Affected if I Decline Testing?

No, the standard of care provided by your healthcare professional will not be affected if you choose not to undergo nutrigenomics testing. However, the dietary, lifestyle, and fitness advice offered will not be tailored to your unique genetic profile.

Client Consent

I have read, or have had read to me, all the above statements and understand the information regarding nutrigenomics testing. I have had the opportunity to ask questions about the testing procedure, risks, and limitations before providing my consent.

By providing my saliva or buccal swab sample, I consent to nutrigenomics testing and the secure storage of my sample for potential future testing. I affirm that the information I have provided is true, accurate, and complete.

If I am ordering this test on behalf of another individual, I confirm that I have the legal authority and appropriate consent to act on their behalf.

By signing this form, I also consent to having my nutrigenomics test results securely transmitted to healthcare professionals at DNA Doctors electronically and connect to electronic communications, acknowledging that email, portals and video calls are not always fully secure form of communication. I further consent to have mine and of those who I have ordered, printed report sent to the address I have provided. Only my first name will appear in the report, with no other identifying information included.

Pharmacogenomics DNA Test

What is Pharmacogenetic Testing?

Pharmacogenetic (PGx) testing is performed using a safe and non-invasive buccal swab collection kit developed for use by healthcare professionals to provide their clients with reliable genetic information. The ultimate goal of PGx testing is to minimize the risk of adverse reactions and aid in the prediction of drug effectiveness on an individual level. The test analyzes variations in genes for over 150 drugs (or drug combinations) across a range of therapeutic areas, including mental health, pain, and cardiology. All recommendations are based on high-quality evidence from key regulatory bodies and expert consortia in pharmacogenetics.

What are the Benefits?

The results of the PGx test allow healthcare providers to adopt a more tailored approach, reducing trial-and-error in prescribing and minimizing the risk of adverse drug reactions. Research suggests that up to 80% of variability in drug efficacy and safety can be accounted for by genetic factors. The PGx test results are relevant over the course of a lifetime by predicting drug effectiveness and can be used as a tool to guide medication use for healthcare practitioners.

What are the Risks?

Some individuals may worry that their genetic information could be used to discriminate against them in their job or for health insurance coverage. In the United States, the Genetic Information Non-Discrimination Act (GINA) was signed into law in May 2008 and offers federal protection against such discrimination. The federal Health Insurance Portability and Accountability Act (HIPAA) of 1996 prohibits employers and health insurers from excluding individuals from group coverage due to genetic predisposition to certain diseases. However, neither HIPAA nor GINA prohibits life insurance companies from using this information.

In Canada, the Genetic Non-Discrimination Act (GNA), formally known as Bill S-201, was passed into law on May 4, 2017. GNA protects individuals from insurance companies and employers from using, requesting, or requiring genetic test results. Employers cannot use a person’s genetic test results to make decisions about hiring, firing, job assignments, or promotions. The Canadian Human Rights Act bans discrimination based on genetic characteristics. However, GNA does not prohibit insurers from using information about an individual's current symptoms and diagnoses, even if the condition has a genetic basis. Family medical history is not protected by GNA.

Note: This test focuses on genes related to drug metabolism and response. If an individual has a PGx test, they may be required to answer "yes" on any legal forms or questionnaires that ask whether they have had a genetic test.

What are the Limitations?

DNA Doctors does not provide medical advice, diagnosis, or treatment. Factors such as age, diet, ethnicity, family health history, and/or personal health unrelated to genetics can also impact the likelihood of developing certain conditions or exhibiting certain drug reactions. Therefore, individuals may not always exhibit the drug response expected or consistent with their genetic test results.

The test results are based upon probabilities and may not provide a 100% definitive conclusion regarding increased toxicity or decreased effectiveness of a given drug. Individuals should not make any changes to medical care, including but not limited to changes in dosage or frequency of medication, without the advice and consultation of a qualified healthcare professional.
